f <br />ORDINANCE NO, k' <br />WHEREAS, a petition was duly filed with. the City Planning <br />Commission of the City of Batesville, Arkansas, asking the City <br />Planning Commission to recommend to the City Council to vacate <br />and abandon parts of James Street, Neill Street, and Long (formerl <br />Albright Street), designated on the plat of Maxfield's Second <br />Southern Addition of the City of Batesville, Arkansas, which plat <br />now appears of record in Independence County Deed Record Book D-3,, <br />Page 347, and which plat was filed for record September 21, 1899; <br />i <br />and <br />WHEREAS, after due notice as required by law, the City <br />Planning Commission heard the petition presented and has recommen <br />to the City Council of Batesville, Arkansas, that said streets be <br />vacated and abandoned, and <br />WHEREAS, there are no owners of property which abut upon the <br />:d <br />portions of the street to be vacated, which owners would be affec4 d <br />by the vacating and abandoning of the street, and <br />WHEREAS, said streets have not been used by the public genera�ly <br />since 1919, and the public interest and welfare will not be <br />adversely affected by the abandonment of such streets, <br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the <br />City of Batesville, Arkansas: <br />Section One: The City of Batesville, Arkansas, hereby releas�s, <br />vacates and abandons all its rights, together with the rights of <br />the public generally, in and to the streets designated as follows: <br />(a) James Street where it runs between Blocks 12 and <br />13 of Maxfield's Second Southern Addition to the City of <br />Batesville, Arkansas; <br />(b) Neill Street where it runs between blocks 13 and 14 <br />of Maxfield's Second Southern Addition to the City of Batesville <br />Arkansas; <br />
