<br />AN ORDINANCE APPROVING AND ACCEPTING THE
<br />ANNEXATION TO THE CITY OF BATESVILLE, ARKANSAS
<br />OF FOUR TRACTS OF LAND ALL IN SECTIONS 9 & 4
<br />OF TOWNSHIP 139 NORTH, RANGE 6 WEST,
<br />IN INDEPENDENCE COUNTY, ARKANSAS
<br />WHEREAS, THE County Court of Independence County, Arkansas, entered
<br />its Order of the day of.
<br />, 1977, upon the petition
<br />of Virgil Butler, Sr., Alvis P. Ball and Neva Be Ball, his wife, Virgil
<br />Butler, Jr. and Wanda Butler, his wife, and J. W. Collier, the sole
<br />owners of the lands to be annexed, after due notice of hearing on said
<br />petition for the time and in the manner prescribed by law, ordering the
<br />annexation of the following described lands located in Independence
<br />County, Arkansas, to -wits
<br />TRACT ONES Virgil Butler, Sr. - Begin on the south right-of-way
<br />line of State Highway #25 at a point 226 feet east of the quarter
<br />section corner between Sections 4 and 9-13-6 and run thence S 4
<br />degrees E 300 feet= thence S 86 degrees W 1122.7 feet to the east
<br />highway right-of-way= thence along said right-of-way S 161 degrees
<br />E 810.7 feet to a 2" iron pipes thence N 86 degrees E 582.5 feet to
<br />a 2" iron pipe on the west right-of-way line of U. S. Highway #167;
<br />thence N 33 degrees E along said right-of-way 288 feet= thence N 28
<br />degrees 53" E 190 feed thence N 33 degrees E 499 feet= thence N 29
<br />degrees 150 E 344 feet to the south right-of-way line of State High-
<br />way #251 thence along said highway N 86 degrees W 100 feet= thence
<br />S 86 degrees W 300 feet to point of beginning containing 19.484
<br />acres, more or less, in NW NE and NE NW Section 9-13-69 in
<br />Independence County, Arkansas.
<br />TRACT TWOs Alvis P. Ball and Neva Be Ball, his wife - All of the
<br />S* of the SWI of the SEI of Section 49 Township 13 North, Range 6
<br />West, lying North and West of Highway 167 North as now located,
<br />containing 17.5 acres, more or less.
<br />TRACT THREEs Virgil Butler, Jr. and Wanda Butler, his wife: Pt. NJ
<br />Section 9, Two. 13 North, Range 6 West described as follows; Begin-
<br />ning at a point on the South R/W line of Hwy. 25 that is 226' East
<br />and 50 feet South from the Quarter Section corner between Sections
<br />4 & 99 T. 13N, R6Ws thence South 4 degrees East 300 feet; thence
<br />South 86 degrees West 1122.7 feet to the East R/W line of Hwy. 691
<br />thence North 16* degrees West along said R/W line 147 feet; thence
<br />North 22 degrees East 144.7 feet to a point on the South R/W line
<br />of Hwy. 25 that is S 86 degrees West 1326 feet from the place of
<br />beginnings thence N 86 degrees East 1326 feet to place of beginning
<br />containing 7.8 acres, All bearings are magnetic.
<br />TRACT FOURS J. W. Collier - A part of the E* of the NWI of Section 9.,
<br />Township 13 North, Range 6 West, in Independence County, Arkansas,
<br />more particularly described as followss Beginning at a point 1141.8
<br />feet South and 57.2 feet West from the NE corner of the NWI, SECtien
<br />9, Township 13 North, Range 6 West, where an iron pipe was set as a
<br />marker for the NE corner of the tract herein described, said point
<br />being in NW right-of-way line of U. S. Highway 167 and 70 feet normal
<br />distance from center lines thence South 38 degrees 30 minutes West
<br />698.6 feet with said right-of-way line to the South corner of this
<br />tract; thence North 51 degrees 30 minutes West, 66.5 feet with right -
<br />Of -way to the State Highway 69 to SW corner of this tracts thence
<br />North 10 degrees 18 minutes West 532.3 feet along right-of-way line
<br />to NW corner of this tracts thence South 88 degrees 13 minutes East
<br />582.3 feet to an iron pin which was the point of beginning for this
<br />tract, said tract contains 4.0 acres, more or less.
