ORDINANCE NO. <br />An ordinance vacating 22nd Street in the City of Batesville, <br />Arkansas, between the South right-of-way line of Harrison Street <br />and the North right-of-way line of Fitzhugh Street in the Fitzhugh <br />Park Addition to the City of Batesville, Arkansas. <br />WHEREAS, a petition was duly filed with the City Council for <br />the City of Batesville, Arkansas, on the day of April, <br />1977, asking the City Council to vacate and abandon all that <br />portion of 22nd Street designated on the plat of the Fitzhugh Park <br />Addition to the City of Batesville, Arkansas, now appearing of <br />record in Deed Book I-7, Page 243 of the Independence County <br />Records, beginning at the South right-of-way line of Harrison <br />Street and ending at the North right-of-way line of Fitzhugh <br />Street. <br />WHEREAS, after due notice as required by law, the Council <br />has, at the time and place mentioned in the resolution, heard all <br />persons desiring to be heard on the question and has ascertained <br />that that portion of 22nd Street, hereinbefore described, has <br />heretofore been dedicated to the public use as a street herein <br />described; has not been actually used by the public generally <br />for a period of at least five years subsequent to the filing of <br />the plat; that all the owners of the property abutting upon the <br />portion of the street to be vacated have filed with the City <br />Council their written consent to such abandonment; and that the <br />public interest and welfare will not be adversely affected by the <br />abandonment of such street. <br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the <br />City of Batesville, Arkansas: <br />Section 1. The City of Batesville, Arkansas, hereby releases) <br />vacates and abandons all its rights, together with the rights of <br />the public generally, in and to the street designated as follows: <br />
