ORDINANCE NO. An ordinance rezoning certain property in the City of Bates- ville, Arkansas, lying in Section 15, Township 13 North, Range 6 West, in Independence County, Arkansas. WHEREAS, the City Planning Commission of the City of Bates- ville, Arkansas, as a part of its comprehensive rezoning program, has recommended to the Batesville City Council that among others, the following described lands lying in Independence County, Arkans s, be rezoned from residential to commercial property: Part of the Northwest Quarter (NW -4) of the Southwest Quarter (SW4) of Section 15, Township 13 North, Range 6 West, described as follows: Beginning at the quarter section corner to Sections 15 and 16, Township 13 North, Range 6 West, run thence South 35 feet along the line between said sections to the South boundary line of Highway 14, thence East and along the South boundary line of said Highway 14 a distance of 730 feet to the beginning corner of the parcel, thence East 95 feet, thence South 300 feet, thence West 95 feet, thence North 300 feet to the place of beginning. WHEREAS, after due notices as required by law, the Council has heard all persons desiring to be heard on the question and has determined that the property's best use is commercial and that the property should be rezoned under the classification C-2; that othe property owners in the area will not be adversely affected by the rezoning and that the general public interest and welfare will not be adversely affected by said rezoning. NOW, THEREFORE, BE IT ORDAINED by the City Council of the Cit of Batesville, Arkansas: Section 1. That the lands described herein shall be rezoned under the classification C-2. Section 2. A copy of the ordinance duly filed by the City Clerk shall be filed in the office of the Recorder of the County and recorded in the deed records of the county.
