ORDINANCE NO . _L1 (:;:, <br />An ordinance rezoning certain property in the City of <br />Batesville, Arkansas, lying in Section 15, Township 13 North, <br />Range 6 West, in Independence County, Arkansas. <br />WHEREAS, the City Planning Commission of the City of <br />Batesville, Arkansas, has conducted a public hearing on the <br />petition of General Investment Company for the rezoning of <br />certain property lying in the City of Batesville, Independence <br />County, Arkansas, and the City Planning Commission has <br />recommended to the Batesville City Council that the following <br />described lands lying in Independence County, Arkansas, be rezoned <br />from commercial C-2 to residential R-3: <br />Part of the Northwest Quarter of the Southwest Quarter <br />Of Section 15, Township 13 North, Range 6 West, <br />described as follows: <br />Beginning at the Quarter Section corner to Sections <br />15 and 16, Township 13 North, Range 6 West, run thence <br />South 35' along the line between said sections to the <br />South boundary line of Harrison Street, thence East <br />and all along the South boundary line of said Harrison <br />Street a distance of 730'; thence South 130' to the <br />point of beginning; thence East 951; thence South 170'; <br />t1lence West 95'; thence North 170' to the point of <br />beginning. <br />WHEREAS, after due notices as required by law, the Planning <br />Commission has heard all persons desiring to be heard on the <br />question and has determined that the property's best use is for <br />multifamily residential housing and that the property should be <br />rezoned under the classification residential R-3; that other <br />property owners in the area will not be adversely affected by the <br />rezoning and that the general public interest and welfare will <br />not be adversely affected by said rezoning. <br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the <br />City of Batesville, Arkansas; <br />(1) That the lands described herein shall be rezoned under <br />the classification residential R-3. <br />(2) A copy of the ordinance duly filed by the City Clerk <br />shall be filed in the Office of the Recorder of the county and <br />recorded in the Deed Records of the county. <br />
