ORDINANCE NO.old/0—/0-OA <br /> • AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR <br /> OTHER PURPOSES. <br /> WHEREAS,a number of properties were annexed into the city of Batesville by ordinance <br /> number 2010-7-2; and, <br /> WHEREAS,the zoning classification of said annexed properties was automatically assigned as <br /> R-1, pending review and recommendation by the Batesville Planning Commission of permanent <br /> classification; and, <br /> WHEREAS, the Batesville Planning Commission has reviewed the relationship of the newly <br /> annexed properties with the Comprehensive Plan;and, <br /> WHEREAS,the Batesville Planning Commission has prepared recommendations to assign <br /> permanent zoning district classifications to said annexed properties, and conducted a properly advertised <br /> public hearing on September 13,2010. <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS <br /> HEREBY AMENDED AS FOLLOWS: <br /> Those properties whose zoning classification was R-I immediately after their annexation into the City <br /> of Batesville are hereby reclassified as shown on Attachment A hereto,which is incorporated herein <br /> by reference. <br /> • <br /> IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD <br /> TO BE INVALID,SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION <br /> OR PORTIONS OF THIS ORDINANCE. <br /> EMERGENCY CLAUSE: Where as it is necessary to effect the public peace,health, safety and <br /> welfare and the orderly administration of Batesville City Codes, an emergency is hereby declared to exist <br /> and this Ordinance shall be effective from and its passage. <br /> IT IS SO ORDAINED. // � <br /> IN WITNESS WHEREOF,we have set our hands this� day of C C/c/' 20/0 <br /> APPROVED: /,j <br /> RICK EL OR --- <br /> ATTEST: 0jr-rLZ �pn� <br /> DENISE JOHNSTON,CLERK <br /> • APPROVED AS TO LEGAL FORM: <br /> Scott Stalker,City Attorney <br />
