ORDINANCE NO. ?C <br />AN ORDINANCE VACATING AND ABANDONING 10TH STREET <br />BETWEEN NEELEY AND BYERS STREETS <br />WHEREAS, a petition was duly filed with the City Council for <br />Batesville, Independence County, Arkansas, on December 12, 1978, <br />asking the City Council to vacate and abandon 10th Street between 1 <br />s <br />Neeley and Byers Streets in the City of Batesville, Independence <br />County, Arkansas; and <br />WHEREAS, after due notice as required by law, the City Council <br />s, at the time and place mentioned in the notice, heard all <br />3ersons desiring to be heard on the question and has ascertained: <br />1. That 10th Street between Neeley Street and Byers Street <br />in Batesville, Independence County, Arkansas, has heretofore been <br />dedicated to the public use as a street herein described. <br />2. That all of the owners of the property abutting upon 10th <br />Street between Neeley Street and Byers Street in Batesville, <br />independence County, Arkansas, has consented to such vacation and <br />andonment. <br />3. That the public interest and welfare will not be adversel <br />ffected by the vacation and abandonment of the street; that 10th <br />treet between Neeley Street and Byers Street in Batesville, <br />Independence County, Arkansas is not required for any corporate <br />se; and <br />4. 10th Street between Neeley Street and Byers Street in <br />tesville, Independence County, Arkansas has never been opened <br />Has a right-of-way to the public and has not been used by or for <br />public as a street or alley for a period of more than five <br />ears last past; and <br />5. That no public inconvenience will result from the closing. <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br />TESVILLE, ARKANSAS: <br />
