ORDINANCE NO. _ �02 <br />An ordinance establishing the appellate process for <br />appeals from the decisions of the Batesville Utilities Commission <br />or its designated Hearing Officer in water and sewer termination <br />hearings, and other purposes. <br />WHEREAS, there currently exists no appellate process <br />for appeals from the decisions of the Batesville Utilities <br />Commission Hearing Officer in water and sewer termination hearingE, <br />and such process being necessary to the orderly administration of <br />justice in the City of Batesville, Arkansas; <br />NOW, THEREFORE, BE IT ORDAINED by the City of <br />Batesville, Arkansas, as follows: <br />SECTION 1: That appeals may be taken from the adverse <br />determinations of the Batesville Utilities Commission, or its <br />designated Hearing Officer, in water and sewer service terminati <br />hearings, within twenty (20) days of the date of decision. <br />SECTION 2: Such appeals shall be taken by giving <br />written notice of appeal filed with the Batesville Utilities <br />Commission by filing at the Batesville Water Office, and with <br />the Clerk of the Municipal Court of Batesville, Arkansas, <br />within twenty (20) days of the date of decision by the Utilities <br />Commission or its Hearing Officer. <br />SECTION 3: Such appeals shall be taken in the <br />Municipal Court of Batesville, Arkansas, and shall in the <br />Municipal Court be trials de novo. <br />SECTION 4: The City Attorney for the City of <br />Batesville, Arkansas, is authorized and directed to represent <br />the City of Batesville, Utilities Commission, in such proceedings <br />before the Municipal Court of Batesville, Arkansas. <br />SECTION 5: Appeals shall be taken from the <br />determination of the Municipal Court in the time and in the <br />manner prescribed by law for all other appeals from the <br />
