ORDINANCE NO. <br />AN ORDINANCE PROHIBITING THE DEPOSIT OF RUBBISH, TRASH, LUMBER, SOIL OR OTHER <br />MATERIALS IN DRAINAGE DITCHES LOCATED WITHIN THE CORPORATE LIMITS OF THE CITY <br />OF BATESVILLE; PROVIDING PENALTIES THEREFOR; AND FOR OTHER PURPOSES: <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE: <br />SECTION 1. It shall be unlawful for any person, persons, firm, company or <br />corporation to place or deposit or cause to be placed or deposited in any <br />storm drain, ditch, gutter or other drain, whether natural or artificial, that <br />carries storm or other surface water, within the City of Batesville, any trash <br />timber, lumber, shingles, planks, bricks, rocks, soil or any other material or <br />rubbish which may obstruct the free flow of water therein or cause water to <br />divert out of said drain or cause water to become stagnant. <br />SECTION 2. Any person, persons, firm, company or corporation who shall <br />violate Section 1 of this ordinance shall be deemed guilty of a misdemeanor <br />and on conviction shall be fined in any sum not less than ten ($10.00) dollars <br />nor more than two hundred fifty ($250.00) dollars with each day of violation <br />of this ordinance being a separate offense of said ordinance. <br />SECTION 3. Any ordinance or part of ordinance in conflict herewith is <br />hereby repealed. <br />SECTION 4. If any section, sentence or portion of this ordinance is for <br />reason held invalid or unconstitutional by any court of competent jurisdiction <br />such portion shall be deemed a separate, distinct and independent provision <br />and such holding shall not affect the validity of the remaining portions <br />thereof. <br />This ordinance being necessary for the prevention of health hazards and for <br />the protection of the city streets and highways and further necessary for the <br />protection of the health, safety and welfare of the citizens of Batesville, <br />11 Arkansas, an emergency is declared to exist and this ordinance shall take ef- <br />fect and be in force from and after the4e of passage. <br />Passed and approved this <Z' day of1979. <br />�r_ c <br />Peyto Golden, Mayor <br />ATTEST: <br />arry Williams, City Clerk <br />
