10 <br />ORDINANCE NO. q1 0 <br />AN ORDINANCE PROHIBITING THE SPILLING OF LOADS UPON THE STREETS AND HIGHWAYS <br />WITHIN THE CORPORATE LIMITS OF THE CITY OF BATESVILLE, ARKANSAS; PROVIDING <br />PENALTIES THEREFOR; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES: <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE: <br />SECTION 1. No vehicle shall be driven or moved on any street or highway <br />within the corporate limits of the City of Batesville unless such vehicle is <br />so constructed or loaded as to prevent any of its load from dropping, shifting, <br />leaking, spilling or otherwise escaping therefrom, except that sand may be <br />dropped for the purpose of securing traction or water or other substances may <br />be sprinkled on a roadway in cleaning or maintaining such roadway. <br />SECTION 2. Any person, firm, company or corporation convicted of driving <br />or having caused to be driven a vehicle upon the streets and highways within <br />the corporate limits of the City of Batesville, Arkansas in violation of Sectio <br />1 of this ordinance shall be deemed guilty of the commission of a misdemeanor <br />and shall be fined not less than ten ($10.00) dollars nor more than one hundred <br />($100.00) dollars. <br />SECTION 3. All ordinances or parts of ordinances in conflict herewith are <br />hereby repealed. <br />SECTION 4. This ordinance being necessary for the maintenance and control <br />of traffic conditions, prevention of traffic and health hazards and further <br />necessary for the protection of the health, safety and welfare of the citizens <br />of Batesville, Arkansas, an emergency is declared to exist and this ordinance <br />(shall take effect and be in force from and after the date of passage. <br />PASSED AND APPROVED THIS , 4f DAY OF <br />ATTEST: <br />1979. <br />f <br />Peyton olden, Mayor <br />J a <br />Larr Williams, City Clerk <br />
