owner shall fail to make such connection after having been <br />so requested in writing, the City hereby covenants and agrees <br />to institute appropriate proceedings in a court of competent <br />jurisdiction to compel such connection. Furthermore, any <br />property owner who fails or refuses to connect his improved <br />property with the sewer facilities after having been so requested <br />by the City shall be guilty of a misdemeanor and upon conviction <br />shall be fined in any sum not less than $2.00 and not more than <br />$10.00, and each day's failure or refusal after the expiration <br />of the time fixed in the notice to make the connection shall be <br />a separate offense; provided, however, that the provisions <br />hereof pertaining to a misdemeanor shall be effective only <br />in the event that the City Health Officer, or other duly designated <br />individual or board, has found and declared that such failure <br />on the part of any particular property owner constitutes a <br />hazard to the public health and safety of the City and its <br />inhabitants. <br />Section 24. (a) The City covenants and agrees that the <br />holders and registered owners of the bonds shall have the <br />protection of the provisions of Section 13 of Act No. 132 of <br />the Acts of Arkansas of 1933, as amended (Ark. Stat. Ann. <br />§19-4113 (Repl. 1968)) ("Act No. 132"), and the City will <br />diligently proceed to enforce the lien of unpaid sewer charges <br />against the premises served by the sewer facilities and to <br />collect the amount due, together with the penalty and expenses <br />authorized by Act No. 132. And, if the City shall fail to <br />proceed within thirty (30) days after written request shall have <br />been filed by the Trustee, the Trustee may, and upon the written <br />request of the holders and registered owners of not less than <br />ten percent (10%) in principal amount of the bonds then out- <br />standing shall, proceed to enforce the lien in accordance with <br />and pursuant to the authorization of Act No. 132. <br />
