ORDINANCE N0020 It— <br /> AN -0 <br /> ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR <br /> OTHER PURPOSES. <br /> WHEREAS, the Batesville Planning Commission has determined, after a public hearing on <br /> January 24,2011,that the Batesville Comprehensive Plan should be amended to support moderate to high <br /> density residential development in the area on the west side of Barnett Drive and south of White Drive; <br /> and, <br /> WHEREAS,the Batesville Planning Commission, after conducting a public hearing on March 7, <br /> 2011, has voted to recommend that said property be rezoned from Commercial Community [C-1] to <br /> General Family Residential [R-2]. <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS <br /> HEREBY AMENDED TO DESIGNATE THE FOLLOWING DESCRIBED PROPERTY AS <br /> GENERAL FAMILY RESIDENTIAL [R-2]: <br /> A tract of land being a part of the NE '/4 of the NE '/4 of the NW 1/4 of Section 9,T13N,R6W, in the <br /> City of Batesville, Independence County, Arkansas,more particularly described as follows: <br /> Beginning at a point that is 232.60 feet south and 920.60 west of the north quarter corner of said <br /> Section 9, said point being on the nominal west right of way line of Barnett Drive: thence S 15°54' <br /> 41"E along said nominal right of way line 611.54 feet;thence S 74° 14' 21"W a distance of 350 <br /> feet;thence N 15° 54' 41"W a distance of 683.33 feet; thence N 85°47' 26"E a distance of 357.06 <br /> feet to the point of beginning,containing 5 acres, more or less. <br /> IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD <br /> �+ TO BE INVALID,SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION <br /> OR PORTIONS OF THIS ORDINANCE. <br /> EMERGENCY CLAUSE: Whereas it is necessary to effect the public peace, health, safety and <br /> welfare and the orderly administration of Batesville City Codes,an emergency is hereby declared to exist <br /> and this Ordinance shall be effective from and its passage. <br /> IT IS SO ORDAINED. <br /> IN WITNESS WHEREOF, we have set our hands this day of // Kul G) , 2011. <br /> APPROVED: <br /> RICK E GH,MAYOR <br /> ATTEST: <br /> DENISE JOHNSTON, CLEAk <br /> R VE O LEGAL FORM: <br /> • Lindsey stlebeKy,City Attorney <br />
