AN ORDINANCE AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE A QUITCLAIM DEED TO THE ARKANSAS STATE HIGHWAY COMMISSION, CON- VEYING CERTAIN RIGHT -OFF -WAY FOR PURPOSES OF CONSTRUCTION OF HIGH- WAY NO. 167. -, THAT WHEREAS, at the present time the Arkansas State Highway Department is preparing to re -construct Arkansas State Highway No. 167 through the City of Batesville, Arkansas, and that WHEREAS, in conjunction with said construction it is necessary for the City of Batesville to convey the within described right-of-way to the State of Arkansas for highway purposes, and that WHEREAS, pursuant to agreements existing between the City of Batesville, and the Arkansas State Highway Commission, the City of Bates- ville is conveying to the Arkansas State Highway Commission title in and to lands dedicated for public use as a street and expressly made available to and used by the Arkansas State Highway Commission for Highway purposes, and that WHEREAS, the description of said lands to be conveyed is more particularly described in the attached centerline description, which is made a part hereof as though set out herein word for word, and that WHEREAS, it is necessary that the City of Batesville convey its title to said lands to the Arkansas State Highway Commission by an instru- ment of conveyance, thereby vesting in the State of Arkansas the complete and full right, title and interest in said lands. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: The Mayor and the City Clerk are hereby authorized and directed to execute on behalf of the City of Batesville, a Quitclaim Deed conveying the above dscribed property to the State of Arkansas, and to deliver said Deed, duly attested to the Arkansas State Highway Commission.
