r M CITY ORDINANCE NO. 1 �, Z, ORDINANCE WITH REFERENCE TO REZONING OF PROPERTY OWNED BY TOMMY JOE GIPSON AND ELLA JANE GIPSON WHEREAS, The City Planning Commission of the City of Batesville, Arkansas, pursuant to law, has filed its recommendatio with the City Council recommending that the following action be made with reference to the proposed reclassification of the property involved herein, that the following described property owned by Tommy Joe Gipson and Ella Jane Gipson, to -wit: A part of Lots 11 and 12, Block 44, Maxfield's Third Eastern Addition to the City of Batesville, Arkansas, described by metes and bounds as fol- lows: Begin at the Southwest corner of Lot 12, thence North along the line dividing Lots 12 and 13 for 100 feet; thence East and in a line parallel with Harrison Street 70 feet; thence South 100 feet to Harrison Street, thence West 70 feet to the point of beginning, said property fronting 70 feet on Harrison Street and extending back uniform depth of 100 feet. be classified as "Neighborhood Commercial --Also Known as C-3;" tha said proposed change would be to the best interest of the City of Batesville; NOW, THEREFORE, Be it ordained by the City Council of Batesville, Arkansas: Section 1: That the City Council adopt a report and recommendation of the City Planning Commission as above set forth and that the lands as hereinabove described be and are hereby classified under the applicable zoning law and regulations to the �s classification of "Neighborhood Commercial --Also Known as C-3." j Section 2: That The City Clerk shall cause the official (zoning map to note the change as above set forth. i Section 3: That there is hereby found and declared to be an immediate need for the reclassification as above set forth for I the benefit of the public health, safety and welfare of the City of Batesville, Arkansas, and particularly the area affected hereby.! NOW, THEREFORE, It is declared that an emergency exists j i I and that this ordinance is necessary for the immediate preservation} hof the public health, safety and welfare and shall be in force ands shall take effect immediately upon and after its passage.
