ORDINANCE NO. "— 1 <br /> AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR <br /> OTHER PURPOSES. <br /> WHEREAS, the Batesville Planning Commission has determined, after a public hearing on June <br /> 6, 2011,that the Batesville Comprehensive Plan should be amended to support future commercial <br /> development in the area on the west side of Central Avenue near its intersection with White Drive;and, <br /> WHEREAS, the Batesville Planning Commission, after conducting a public hearing on June 6, <br /> 2011, has voted to recommend that said property be rezoned from Single Family Residential [R-I] to <br /> Commercial Community [C-I]. <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS <br /> HEREBY AMENDED TO DESIGNATE THE FOLLOWING DESCRIBED PROPERTY AS <br /> COMMUNITY COMMERCIAL [C-1]: <br /> A tract of land being a part of the N 'h of the NW '/<of Section 8, TI3N, R6W, in the City of <br /> Batesville, Independence County, Arkansas, more particularly described as follows: <br /> Beginning at a point that is 1,512 links and 525 feet East of the SW corner of said half quarter <br /> section; run thence East 300 feet to the southwesterly line of State Highway number 69,as now <br /> located; thence N 43°W along said southwesterly line of said Highway number 69 a distance of 219 <br /> feet;thence S38°W to the point of beginning. <br /> IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD <br /> TO BE INVALID,SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION <br /> OR PORTIONS OF THIS ORDINANCE. <br /> EMERGENCY CLAUSE: Whereas it is necessary to effect the public peace, health, safety and <br /> welfare and the orderly administration of Batesville City Codes,an emergency is hereby declared to exist <br /> and this Ordinance shall be effective from and its passage. <br /> IT IS SO ORDAINED. <br /> IN WITNESS WHEREOF, we have set our hands this9-day of ,2011. <br /> APPROVED: <br /> RICK B , AYOR <br /> ATTEST: <br /> DINKE'KYRNSTON, CL C <br /> AV <br /> UO- S TO LEGAL FORM: <br /> Lindsey astl erry, City Attorney <br />
