!/ <br />Now <br />J—. <br />BEFORE THE CITY COUNCIL OF BATESV ILLE , ARKANSAS <br />ORDINANCE CLOSING & VACATING A PORTION OF PARK STREET <br />Whereas a petition was duly filed with the City Council <br />of the city of Batesville, Arkansas on the 7th day of July, <br />1966 asking the city council to vacate and abandon all that <br />portion of the street designated on the plat of East End <br />Heights Addition to said city now appearing of record in <br />deed record & plat book Q-3 p.221; deed record & plat book <br />0-4 P.531; deed record & plat book E-6 p.153 in the office <br />of the Recorder of Independence County, Arkansas and described <br />as follows: <br />That portion of Park Street which lies South of the <br />West Half of Block 15 in the East End Heights Addition <br />to the City of Batesville, Arkansas <br />That portion of Park Street which lies North of Block <br />131 in the East End Heights Addition to the City of <br />Batesville, Arkansas <br />Whereas after dui; notices as required by law, the <br />council has at the time and place mentioned in the notice <br />heard all persons desiring to be heard on the question and <br />has ascertained that the street or portion thereof herein- <br />before described has heretofore been dedicated to the public <br />use as a street herein described; has not been actually used <br />by the public generally for a period of at least five years <br />subsequent to the filing of the plat; that all the owners of <br />the property abutting upon the portion of the street to be <br />vacated have filed with the Council their written consent to <br />such abandonment and that the public interest and welfare <br />will not be adversely affected by the abandonment of such <br />street. <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br />THE CITY OF BATESVILLE, ARKANSAS: <br />Vrnnrtt & Pnrttr <br />ATTORNEYS AT LAW <br />BARNETT BUILDING <br />BATESVILLE, ARKANSAS <br />
