Tract 3: A part of the Eash Half of the <br />Southeast Quarter of Section 17, Township <br />13 North, Range 6 West, described as follows: <br />Beginning at the intersection of Lawrence <br />and River Streets on the north side of <br />Lawrence Street and the west side of River <br />Street; thence north along the west side of <br />River Street 320 feet to the intersection <br />of Broad Street; thence north 36 degrees west <br />and along the west side of Broad Street 140 <br />feet; thence southwest and at right angles to <br />Broad Street 186 feet and 6 inches to place <br />of beginning; thence continue southwest 22 <br />feet to fence; thence north 36 degrees west <br />and parallel with Broad Street 75 feet to <br />fence and end of wall; thence northeasterly <br />and at right angles to Broad Street 74 feet; <br />thence south 96 feet to place of beginning. <br />be classified as ''commercial`' and that said proposed change <br />would be to the best interest of the City of Batesville; <br />NOW, THEREFORE, Be it ordained by the City Council of <br />Batesville, Arkansas, <br />Section 1: That the City Council adopts a report and <br />recommendation of the City Planning Commission as above set <br />forth and that the lands hereinabove described be and are hereby <br />reclassified under the applicable zoning law and regulations to <br />the classification of "commercial-' property with the use to be <br />restricted to that of a parking area and the present structure <br />may be used for warehousing or storage of merchandise, supplies <br />and equipment. <br />Section 2: That the City Clerk shall cause the <br />official zoning map to note the changes as above set forth. <br />Section 3: That there is hereby found and declared to <br />be an immediate need for the reclassification above set forth <br />i <br />for the benefit of the public health, safety and welfare of the <br />City of Batesville, Arkansas, and particularly the area affected <br />i <br />hereby. <br />i <br />NOW, THEREFORE, It is declared that an emergency exists) <br />and that this ordinance be necessary for the immediate preservation <br />of the public health, safety and welfare and shall be in force <br />and shall take effect immediately upon and after its passage. <br />
