<br />fttion 1. Every female who shall, in the City of Batesville, Arkwisas, offer or tender
<br />ers;V'Tcr than purpose of prostitution, illicit intercourse, or who shall be in the
<br />habit of receiving or making visits therefor, shall, together with her male paramour
<br />or visitor, be guilty of a nisdemeanor and a violation of this Ordinance.
<br />Section 2. .Illicit sexual intercourse within the City of Batesville, Arkansas, be, and
<br />sM is hereby declared a ni.sdemeanor.
<br />8ectio3l 3. Any person found guilty in Mayor's Court of violating Section One or Section
<br />'moo o?Mis Ordinsnoe shall be fined in any sum not less than five dollars nor more than
<br />twenty-five dollars, and for each subsequent offense shall be fined not less than twenty--
<br />five
<br />wenty-five dollars nor more than one hundred dollars.
<br />Section 4, Whenever any person is found guilty of violating; Section One of this Ordinance,

<br />o'eT Ta`el shall be reported by the YWyvr to the City health Officer3 and, on such con-
<br />viction, the Mayor of the City Stealth Officer is authorised to cause such person to be
<br />detained and examined by the City Health Officer or by any physician designated by the
<br />City Health Officer'by use of the neoessary nests end examinations, including the Wasser-
<br />maun blood test,, to ascertain the presence of any venereal disease in a communicable
<br />state« provided that any evidence so acquired shall not be used against such person in
<br />any criminal prosecution.
<br />Section 6. Whenever any persons, after the examination provided in Seetion Four of this
<br />'Ord �"'naxuse, is found to be infected with a venereal disease in a communicable stage, the
<br />City Health Officer may, pending the imposition of or at the expiration of any jail
<br />sentence imposed on such persons when in the axIre�,�t a of his discretion he believes that
<br />the public health requires it, oommit such person,-= be infected with a venereal disease
<br />in a caunicable stage who fails to take treatment adequate for the protection of the
<br />public health, to a hospital or other place designated by the Citl Ilcalth Officer as a
<br />place of quarantine in the State of Arkansas for such treatnent, even over the objection
<br />of such person so diseased or infected, provided the commitment can be done without en-
<br />dangering the life of the patient.
<br />Section 6. Any person who, after the examination providod in Section Four of this ozd-
<br />' aZc� Is found to be infected with a venereal disease in a cozmaunicable stage, and
<br />is committed to a hospital or other place of quarantine as provided in Suction 6 of
<br />this Ordinance, and who fails to remain in such place of cmamaitraent or other place of
<br />quarantine, or any person who fails or refuses to take treatment as prescribed by the City
<br />Stealth Officer shall be ptmished as for oonter,pt of court, and shall be guilty of a mis-
<br />dameanor, and on conviction: in the Mayor's Court shall be fined in any num not less than
<br />twenty-five dollars nor more than two hundred dollars.
<br />Section 7. Sections 2060 207, 208, 200,, 210, 211 and 212 of Reredc>r's DiCest of the Ord -
<br />noes of the City of Batesville, Arkansas, be and the same are hereby repealed.
<br />Section 8. If any paart, phrase, clause, section or sub -section of this Ordinance be held
<br />uwi onstitutional or invalid, such unconstitutionality or invalidity shall not af-
<br />fect the validity of the remaining portions of this Ordinance.
<br />Section 9. It is ascertained and declared that the present lavers suppressing; and punishing
<br />vv5; aM"ir oral practiote in the City of Statesville are inadequate at this time, and that
<br />because of such the health and lives of the inhabitants arra greatly endangered. It is
<br />therefore declared that an emergency exists, that this Ordinance is necessary for the Ira-
<br />mediate
<br />remediate preservation of the public peace, health and safety, and that this Ordinance shall
<br />take effect and be in force from and after its passage and publication.
