<br />,sec� 1. D,FZ II"iION.- -he following definitions shall aPP1y in
<br />the interprat£ttion and the enforcement of this ordinance:
<br />A. K;MAWRY. i".- The term "restaurant" she'll mean restaurant, coffee shop,
<br />ca+feteris, $hart order cafe, luncheonette, tavern, sandwich stand, socia
<br />fountain, and all other eatitg air hich frinking eed crrdrinkbisshmntst as preparod for eszalell s
<br />kitchens or other places in w
<br />elsewhere.
<br />B. ITII�<,k;�°''i' ':b Tr��'?Ai T.- The term "itinerant restaurnnt" shall mean one
<br />operating for a temporary period in connection with a fair, carnival, circus,
<br />public exhibition, or other similar gathering.
<br />C. �- .- teres ''amployee" shall wean any person who handles food or f
<br />drink during preparrtion or serving, or who comes in contact with any eating
<br />or cooking utensils, or who is employed in a room in which food or drink is
<br />j re p,,wed or served.
<br />"Utensils" shall inclu-.e any kitchenware, tableware. glasswnrd,
<br />cutlery, utensils, containers, or other equipment with which food or drink
<br />comes in contact during storni7e, preparation, or servin_7.

<br />The term "health officer" shall mean the l;=�nith Author-
<br />ity of Independence County, the City of Bstesvi.V a or his authorized
<br />reprosent tive.
<br />F. =; :, .- The word "peirson" shall ,acan person, firm, corpor ILLI r , or
<br />association.
<br />Section 2. Y:Railr..- It shall be unlawful for any persor= to oiler to a
<br />restaurant in the city of Batesville who does not possess an unrovoked permit
<br />from the health officer, such permit shall be posted in a conspicuous place.
<br />Only persons who Imply with the requirements of this ordinance shall be
<br />entitled to receive and retain such a permit. A person conducting an stirs ra4t
<br />restaurant shall also be rewired to secure a permit.

<br />FUt3 OR GRIM.- Sao les of food, drink, and other substances my be taken
<br />and examined by the health officer as often as may be necessary for the de-
<br />tection of unwholesomeness or adulteration. The health officer yccondemn
<br />and forbid. the sada of, or cause to be removed or destroyed, any
<br />or
<br />drink which is unwholesome or adulterated.
<br />eco ani Z " t )CTIou OF A�:.�S`T. T1R'NT:..- At least once every six (6)
<br />months the health officer shall inspect every restaurant located within the
<br />city of Batesville. In case the health officer discovers the violation of am
<br />item of sanitation he shall make a second inspection atter the lapse of which:
<br />tires as he deems necessary for the defect to be remedied, and t`.e second
<br />inspection shall be used in determining compliance with the requirements of
<br />this ordinance. Any violation of the same item of this ordinance on such
<br />second inspection shall call for i7inediate suspension of permit.
<br />One copy of the inspection report shall be posted by the health officer
<br />upon an inside wall of the restaurEant, and said inspection report shall not bO
<br />defaced or removed by any person except the health office. Another copy
<br />of the inspection report shall be filed with the records of the proper
<br />health authority.
<br />The person operating the restaurant shell upon request of the health
<br />officer permit access to all parts of the establishsraent and shall per�sit
<br />wa
<br />copying any or all records of food purchased.
