0 ORDINANCE NO._.:El'Y AN ORDINANCE TO LEVY A TAX ON THE PRIVILEGE OF ENGAGING IN THE TAXICAB BUSINESS, AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: Section 1. DEFINITIONS. The word "taxicab" as used herein shall mean and refer to -motor driven vehicles having a seating capacity not in excess of seven (7) persons and used for the transportation of persons for hire; and, the words "taxicab business" as used herein shall mean and refer to any person, firm or corporation owning and operating a taxicab or taxicabs. Section 2. It shall be unlawful for any person, firm or corporation to engage in, carry on or operate any taxicab business within the City of Batesville, Arkansas, without first having obtained and paid an annual license therefor from the City Recorder. Section 3. Any person, firm or corporation failin to pay to the City Recorder of each year shall t e cense fee or tax due hereunder on or before be subject to a fine as fixed by Section 4 hereof; pr ded, however, such license fee or tax for the remainder of this fiscal year, as above defined shall be due on or before November /a , and in a sum equivalent to of the annual license or tax provideerein. Section 4. Any person, firm or corporation violating any stick of the prov- s ons o this ordinance shall be deemed guilty of a misdemeanor, and upon conviction shall be fined in any sum not more than double the amount of the license due, and each day's violation shall be and constitute a separate offense. Section 5. Should any part of this ordinance be declared void or invalid, its all not affect the remaining portions thereof; and all ordinances or parts of ordinances in conflict herewith are hereby repealed, zpW&ft spec- ifio reference being hereby made to Ordinance No. 568 of said City. It is ascertained and declared that the City of Batesville, Ark" ans expends x", pends great sums in the regulation of taxicabs, and is gw2erally in used of additional revenues at this time which if not immediately secured will impede its necessary governmental functions and therey endanger the peace, health and safety of its inhabitants. It is therefore declared that an emer- gency exists, that this ordinance is necessary for the immedz a preservation pf the public peace, health and safety, and that this ordip`nc# shall take ef- fect and be in full force from and after its passage and dpublication.
