CITY COUNCIL OF THE CITY OF <br />BATESVI LLF , ASS AS $ <br />1. Whereas a petition was duly filed with the City <br />Council of the City of Batesville, Arkansas, an the 28th day of <br />January, 19479 asking the City Council to vacate and abandon all <br />that portion.. of Twenty-first Street and Twenty-►seoond Street <br />in East End Heights Addition, between Main Street and College <br />i <br />Avenue, said streets being designated on the plat of East End <br />i <br />Heights Addition to the City of Batesville, Arkansas now appe*ring <br />of record in Deed Record Boom 00-41 at page 534, in the Office � <br />of the Recorder in and for Independence County, <br />Arkansang as <br />Fourth Street and an un -named street east of Fourth Street. <br />2, Wh<-Ilreas, after due notices as rewired by law, <br />the Council has* at the time and place mentioned in said notice9 <br />heard all persons desiring to be heard on the question and has <br />ascertained that the streets, or portions thereat' hereinbefore <br />mentioned, have heretofore been dedicated to the public use as <br />streets herein described; have not been actually used by the <br />public generally for a period of at least five years subsequent <br />to the filing of the plat aforesaid; that all the owners of <br />property abuting upon the portion of said streets to be vacated <br />have filed with the Council their written consent to such abandon <br />meet; and that the public interest and welfare will not be advert <br />rely affected by the abandongment of such streets. <br />NOW, THEREFORE, Be It Ordained by the City Council <br />of the City of Batesville, Arkansas, as follows$ <br />Section Is The City of Batesville, Arkansas, hereby <br />releases, vacates and abandons all its rights, together with <br />the rights of the public in general, in and to the streets des- <br />ignated as followss Twenty-first Street and Twenty-second Street, <br />between Main Street and College Avenue in bast End Heights <br />Addition to the City of Batesville, Arkansas, and being designatd <br />on the plat of said Addition now of redord in Deed Record Boot <br />IG -41 at page 534 of the need Records in and For Independence � <br />
