obligations of the City, but are special obligations payable solely <br />from revenues derived from the project. In this regard, the project <br />has been leased to Eatesville Rubber Company, an Arkansas corporation <br />(herein referred to as "Eatesville Rubber Company"), for a rental at <br />least sufficient to pay the principal of, interest on and paying <br />agent's fees in connection with the bonds as the same become due and <br />payable. Rental payments sufficient for said purposes are to be paid <br />to the Trustee and deposited in a special account designated "City <br />of Eatesville, Arkansas Industrial Development Revenue Bond Fund - <br />Batesville Rubber Company Project". The rental payments and revenues <br />derived from the project have been and are hereby duly pledged for <br />the payment of the principal of, interest on and paying agent's fees <br />in connection with the bonds as the same become due and payable. In <br />addition, the indebtedness evidenced by the bonds is secured by a <br />first mortgage on the project. The bonds do not constitute an in- <br />debtedness of the City within any constitutional or statutory limita- <br />tion. <br />The holder of this bond shall have no right to enforce the <br />provisions of the Indenture or to institute action to enforce the <br />covenants therein, or to take any action with respect to any event of <br />default under the Indenture, or to institute, appear in or defend <br />any suit or other proceeding with respect thereto, except as provided <br />in the Indenture. In certain events, on the conditions, in the man- <br />ner and with the effect set forth in the Indenture, the principal of <br />all the bonds issued under the Indenture and then outstanding may <br />become or may be declared due and payable before the stated maturity <br />thereof, together with interest accrued thereon. <br />Modifications or alterations of the Indenture, or of any <br />indenture supplemental thereto, may be made only to the extent and <br />in the circumstances permitted by the Indenture. <br />
