The duties of the City Council shall include that of hearing and deciding all permits under Section 18. Section 21, Judicial Revie4jr. by any decision of the City Counany person aggrieved, or taxpayer affected, cil may appeal to the Circuit Court of Indepen- dence County as provided in Section 6 of The Airport Zoning Enabling; Act, pct 116, Acts of 4; rkansas, 1941. Section 22. Penalties. Each violation of this ordinance or of any regulation order or ruling promulgated hereunder shall be punishable by a fine of not more than '100.00 or imprisonment for not more than thirty days, or both such fine and imprisonment, and each day a violation continues shall be a separate offense. Section 23. Severability. If any of the provisions of this ordinance or the application thereof to any person or circumstances is held invalid, such in- validity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable. Section 24. Emargencv Clause. It is ascertained and declared that the prevention of the creation or establishment of airport hazards is immediately necessary for protecting the lives and property of users of the Batesville Muni- cipal Airport and of occupants of land in its vicinity and for preventing destruc- tion or impairment of the utility of the airport and the public investment therein; than an emergency exists; and therefore for the immediate preservation of the public peace, health and safety this ordinance shall be in full force and effect immediately upon its passage and approval, Passed and approved this _ 1 p day of AU 1 19� i .. _..:..._. _ _• i 1e-�`...:+tet..
