<br />AN ORDINANCE PROVIDING THAT THE CITY CLERK OF BATESVILLE
<br />SHALL BE EX -OFFICIO CLERK OF THE MUNICIPAL COURT OF BATES-
<br />WILLE, ARKANSAS; PRESCRIBING DUTIES AND FIXING REMUNERATION
<br />OF SUCH EX -OFFICIO CLERK OF SAID MUNICIPAL COURT, AND OTHER-
<br />WISE IMPLEMENTING THE OPERATION OF SAID COURTS REPEALING
<br />ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH;
<br />AND FOR OTHER PURPOSES.
<br />BE IT ORDAINED BY THE CITY COUNCIL OF' TEE CITY OF BATE. -MLLE, ARKANSAS:
<br />Section 1. That the duly elected City Clerk of the City of Batesville, Ark-
<br />ansas, be and such officer is hereby designated and constituted as Ex -officio
<br />Municipal Court Clerk of the Municipal Court of Batesville, Arkansas, and
<br />shall perform all duties incident to such office. As Ex -officio Clerk of
<br />said Court, said officer shall receive an annual salary of Six Hundred Dol-
<br />lars, payable exclusively out of the fund and "Account" hereinafter set forth.
<br />Such officer as City Clerk and Ex -officio Municipal Court Clerk shall, for
<br />each term of said office, execute and provide a bond, conditioned on due and
<br />faithful performance of all the duties of said offices and the proper account-
<br />ing for all funds that may come into his hands, in the sum of
<br />Dollars, with surety thereon a corporate bonding company duly authorized to do
<br />business in the State of Arkansas, and said. City shall pay the premium on such
<br />bond.
<br />Section 2. That like Clerk's fees shall be allowed and taxed as costs by the
<br />Tu'nicip67 Court of Batesville, Arkansas, as are now provided, or may be here-
<br />after provided, by statutes of the State of Arkansas. ,All such fees and costs
<br />shall be remitted and paid over, on or before the fifth day of each month, by
<br />said Clerk to the City Treasurer of Batesville, who shall set up a distinct
<br />and separate account in which such funds shall be kept to be designated as the
<br />"Municipal Court Clerk Salary Fund Account". Settlement shall be made by said
<br />Clerk, on or before the fifth day of each month, of all fines coming into his
<br />hands, payment to be made to respective governmental units entitled thereto un-
<br />der State statutes in such cases made and provided.
<br />Section 3. The salary of such officer as Ex -officio Clerk of said Court shall
<br />e pai2l in monthly installments on warrents drawn on the City Treasurer out of
<br />said "Municipal} Court Clerk Salary Fund Account". If the funds in said
<br />"Account" shall be insufficient to pay in full the compensation and salary
<br />provided,by this ordinance then, and in such event, the salary of such officer
<br />as Ex -officio Clerk of said. Court shall be reduced ratably and in like propor-
<br />tion to the amount of funds in said "Account". Any surplus funds remaSning
<br />in said "Account" in excess of the sum of One Hundred Dollars, which is fixed
<br />as a cushion, at the end of each fiscal year, shall be paid over and transferred
<br />by warrants drawn on the City Treasurer as follows: one-half to the general
<br />funds of the City of Batesville, and one-half to the general fund of Indepen-
<br />dence County, Arkansas.
<br />Section 4. Such Ex -officio Clerk of said Court, as to all matters and procedures
<br />not herein specifically set forth, and all other officers serving in any manner
<br />said Municipal Court, shall., as to all reports and accountings and all other
<br />duties in relation to said Court, be governed by the State statutes in such
<br />cases made and provided.
<br />Section 5. All ordinances or parts of ordinances in conflict herewith are here-
<br />by
<br />Section 6. It is ascertained and declared that the lack of a separate and dis»
<br />�ctunicipal Court Clerk for the Municipal Court of Batesville, Arkansas, impe-
<br />des the efficiency of said Court and endangers the peace and safety of our citi-
<br />zens. It is therefore declared that an emergency exists, that this ordiance is
<br />necessary for the immediate preservation of the public peace, health and safety,
<br />and that this ordinance shall take effect and be in force frori and after passage.
