Adams and <br />Tract 3 belongs to Malcom Moore and Edith Mone, <br />his wife. <br />And whereas, the City Planning Commission, pursuant tc <br />law, has filed its recommendations Vith the City Council, recom- <br />mending the following action as concerns the reclassification: <br />1. That Tract 3, as above described, belonging to Mal- <br />com Moore and Edith Moore, be changed to classification of C-11 <br />"Central Business District." <br />2. That Tract 22 as above described belonging to Ansel <br />L. Adams be changed to Classification of C-13 Central Business <br />District", but that Tract 1 as above described, remain as a Resi- <br />dential District. <br />NOW THEREFORE, BE IT ORDAINED BY THE City Council of <br />the City of Batesville, BE <br />Section 1: That the City Council adopts the report <br />and recommendation of the City Planning Commission as above set <br />forth, and that Tract 3 as above described, be and is hereby re- <br />classified under the applicable zoning law and regulations to <br />the class of C-1, Central Business District", and that likewise, <br />Tract 2 as above described, be and the same is hereby reclassified] <br />under the applicable zoning law and regulations to the Class of <br />C-1, Central Business District and that Tract 1 as above described] <br />is not reclassified, but shall retain its classification as Resi- <br />dential property at this time, without prejudice to the owner of <br />Tract 1 to later ask for reclassification under applicable law <br />and regulations of this city. <br />Section 2: That the City Clerk shall cause the official <br />zoning map to note the changes above set forth. <br />Section 3: That there is hereby found and declared to <br />be an immediate need for the relcassification above set forth <br />for the benefit of the public health, safety and wd.fare of the Citi <br />of Batesville, Arkansas, and particularly the area affected here- <br />by.
