ORDINANCE NO. 2012-01-0!1 <br /> AN ORDINANCE TO AMEND VARIOUS PROVISIONS OF THE BATESVILLE <br /> ZONING CODE; TO MODIFY CERTAIN PROVISIONS RELATING TO <br /> REQUIRED CONDITIONS FOR USES IN GENERAL INDUSTRIAL ZONING <br /> DISTRICTS; AND FOR OTHER PURPOSES. <br /> WHEREAS,certain provisions of the Batesville Zoning Code with respect to required <br /> conditions for permitting uses in General Industrial Districts [I-2]are inappropriate;and, <br /> WHEREAS,updating these provisions is desirable to allow for appropriate industrial <br /> development in the City of Batesville;and, <br /> WHEREAS,the Batesville Planning Commission has prepared recommendations to improve the <br /> efficient and effective application of the Batesville Zoning Code,and conducted a properly advertised <br /> public hearing on December 6,2011, <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE <br /> CITY OF BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING CODE IS <br /> HEREBY AMENDED AS FOLLOWS: <br /> Section 1. General Industrial District[I-2] Required Conditions <br /> The fust sentence of Title 14,section 14.08.02.B.I of the Batesville Municipal Code is hereby <br /> deleted in its entirety. Said section shall be replaced and shall now read as follows: <br /> © 1. All outside storage shall be screened by a site obscuring fence or shrub. <br /> IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR <br /> HELD TO BE INVALID,SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING <br /> PORTION OR PORTIONS OF THIS ORDINANCE. <br /> IT IS SO ORDERED. <br /> IN WITNESS WHEREOF,we have set our hands this 24th day of January,2012. <br /> APPROVED: <br /> — <br /> RICK EL`��UGH, MAYOR <br /> ATTEST: <br /> DENISE JOHNSTON, VLERK <br /> APP O ED A LEGAL FORM: <br /> T.
