M <br />D. If the use of the %%-hole or any part of ti,e leased <br />premises shall be taken by right of eminent domain, this Lease and Agree- <br />ment shall not be thereby terminated and the parties shall continue to be <br />obligated under all of its terms and provisions. If such taking is for a <br />period of time ending on or prior to the expiration of the term, Lessee <br />shall be entitled to receive the entire amount of the award made for such <br />taking, whether by way of damages , rent or otherwise. If such taking is <br />for a period of time which extends beyond the expiration of the ten -n, <br />Lessee shall be entitled to receive the entice award, with the exception <br />of an amount sufficient to pay and discharge all sums due Lessor from <br />Lessee from the time Lessee's right of possession is terminated to the <br />expiration of the term. <br />Section 1402. <br />In the event of a taking of all or substantially <br />all of the leased premises as provided in Section 1401 A, notwithstanding <br />the provision therein that the rent shall be paid to and adjusted as of the <br />fifteenth day after vesting of title in the taking authority, the Lessee agrees <br />to continue to make payment of the basic rent and the additional rent until <br />the condemnation award shall be actually received by the Lessor; provided, <br />however, the Lessee shall be repaid solely out of the net condemnation <br />award the amount of rent so paid after the date provided in Section 1401 A <br />for the adjustment of rent. This agreement to repay shall not be construed <br />in any way to impair or diminish Lessee's obligations under Section 1401 <br />to pay as additional rent the amount of any insufficiency of the net <br />condemnation award and the funds in the Bond Fund to pay the total bond <br />redemption expense as therein defined. <br />Section 1403. Notwithstanding the fact that all or any part of the <br />leased premises shall be taken by right of eminent domain, Lessee shall <br />
