cm 2. r.rrr All machinery, equipment and other personal property of every kind and nature whatever acquired by the City and paid for out of the Con- struction Fund and placed on and in the land and improvements described in "1" above, or elsewhere, including, without limitation, all replacements and substitutions which become the property of the City pursuant to the provisions of the Lease Agreement. All such machinery, equipment and other personal property shall be identified in a ledger, one copy of which shall be filed with the Trustee and one copy maintained by Westport on the mortgaged property. In this regard, all machinery, equipment and other personal property of whatever nature situated on and in the land and improvements described in "1" above shall be conclusively deemed to be owned by the City rather than Westport, unless purchased and placed by Westport and marked by an appropriate tag or other device as being the property of Westport. Included herein is"Lessor's Machinery and Equipment" as defined in the Lease Agreement but, as provided in the Lease Agreement, there is not included any machinery, equipment and personal property owned by Westport. 3.
