CM <br />0 <br />question the propriety of the execution thereof, or to enjoin or restrain the <br />Trustee or the City from executing the same or from taking any action pursuant <br />to the provisions thereof. Upon the execution of any such supplemental indenture, <br />this Indenture shall be and be deemed to be modified and amended in accordance <br />therewith. <br />Section 1203. Anything herein to the contrary notwithstanding, a supple- <br />mental indenture under this Article XII shall not become effective unless and until <br />the Lessee under the Lease Agreement shall have consented to the execution and <br />delivery of such supplemental indenture. In this regard, the Trustee shall cause <br />notice of the proposed execution and delivery of any such supplemental indenture <br />together with a copy of the proposed supplemental indenture to be mailed by <br />certified or registered mail to the Lessee under the Lease Agreement at least fifteen <br />(15) days prior to the proposed date of execution and delivery of any such supple- <br />mental indenture. The Lessee under the Lease Agreement shall be deemed to have <br />consented to the execution and delivery of any such supplemental indenture if the <br />Trustee receives a letter signed by an authorized officer of the Lessee of the Lease <br />Agreement expressing said consent within fifteen (15) days after the mailing of <br />notice and a copy of the proposed supplemental indenture to the Lessee under the <br />Lease Agreement or if the Trustee does not receive a letter signed by an authorized <br />officer on or before 4:00 o'clock p.m., C,S.T., of the fifteen th day after the mailing <br />of said notice, the Lessee under the Lease Agreement shall be deemed to have con- <br />sented to the execution and delivery of such supplemental indenture. <br />
