• ORDINANCE NO. 2012-JL-J__ AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE THE BATESVILLE WATER DEPARTMENT TO CONTRACT FOR THE PURCHASE OF A TRENCH COMPACTOR WHEREAS, the City of Batesville Water Department's is in need of a trench compactor for its multiple ongoing repair and rehabilitation projects throughout the City; WHEREAS, the competitive bidding process is not feasible because this piece of equipment is needed as soon as practicable, and work has already been delayed because the City does not own such a piece of equipment; WHEREAS, it is necessary for the public health, safety and welfare to procure a trench compactor as soon as possible; and WHEREAS, the City of Batesville Water Department, through City Engineer Damon Johnson, has recommended the matter be referred to the full Council for approval. • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS: Section 1. That it is necessary for the City of Batesville Water Department to immediately contract for the purchase of a trench compactor. Section 2. That Darragh Company has quoted a price of $35,198.91 for purchase and delivery of a Wacker 0620293 RT82-SC2 trench compactor. Section 3. That, since competitive bidding is not feasible or practical because of the immediate need for this equipment for repairs, as well as the specific and unique nature of the equipment, the City Council in accordance with the terms of Ark. Code Ann. § 14-58-303(b)(2)(B) hereby waives the bidding requirements and directs the City of Batesville Water Department to enter into the above- described contract for on or about the price set forth in Section 2 above. Section 4. EMERGENCY CLAUSE: It is further found that due to the immediate need to acquire the above described equipment, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect from and after its passage and • approval.
