• ORDINANCE NO. 2012-JL-J__ <br /> AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND <br /> AUTHORIZE THE BATESVILLE WATER DEPARTMENT TO <br /> CONTRACT FOR THE PURCHASE OF A TRENCH COMPACTOR <br /> WHEREAS, the City of Batesville Water Department's is in need of a <br /> trench compactor for its multiple ongoing repair and rehabilitation projects <br /> throughout the City; <br /> WHEREAS, the competitive bidding process is not feasible because this <br /> piece of equipment is needed as soon as practicable, and work has already been <br /> delayed because the City does not own such a piece of equipment; <br /> WHEREAS, it is necessary for the public health, safety and welfare to <br /> procure a trench compactor as soon as possible; and <br /> WHEREAS, the City of Batesville Water Department, through City <br /> Engineer Damon Johnson, has recommended the matter be referred to the full <br /> Council for approval. <br /> • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br /> BATESVILLE, ARKANSAS: <br /> Section 1. That it is necessary for the City of Batesville Water Department <br /> to immediately contract for the purchase of a trench compactor. <br /> Section 2. That Darragh Company has quoted a price of $35,198.91 for <br /> purchase and delivery of a Wacker 0620293 RT82-SC2 trench compactor. <br /> Section 3. That, since competitive bidding is not feasible or practical <br /> because of the immediate need for this equipment for repairs, as well as the specific <br /> and unique nature of the equipment, the City Council in accordance with the terms <br /> of Ark. Code Ann. § 14-58-303(b)(2)(B) hereby waives the bidding requirements <br /> and directs the City of Batesville Water Department to enter into the above- <br /> described contract for on or about the price set forth in Section 2 above. <br /> Section 4. EMERGENCY CLAUSE: It is further found that due to the <br /> immediate need to acquire the above described equipment, an emergency is <br /> declared to exist and this ordinance being necessary for the preservation of the <br /> public peace, health and safety shall take effect from and after its passage and <br /> • approval. <br />
