ORDINANCE NO. 2007-1-3 <br /> AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE <br /> PURCHASE OF AN AERIAL PLATFORM APPARATUS FOR THE CITY OF <br /> BATESVILLE FIRE DEPARTMENT <br /> WHEREAS, the citizen's of the City of Batesville voted on and passed a <br /> 1/8 of 1 percent sales tax to be used for the purchase of an Aerial Platform <br /> Apparatus and other purposes. <br /> WHEREAS, the Batesville Fire Department through Chief Danny Russell <br /> have recommended the matter be referred to the full council for approval. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br /> BATESVILLE, ARKANSAS: <br /> Section 1. That the City of Batesville Fire Department needs to purchase <br /> an Aerial Platform Apparatus and that said equipment is to be as follows: <br /> Rosenbauer GSE Demo Cobra 104 Aerial Platform Apparatus <br /> Section 2. That said apparatus is to be purchased from the Rosenbauer <br /> Company for the approximate sum of $742,130.00, more or less. <br /> Section 3. That the City Council in accordance with the terms of A.C.A. <br /> Section 14-58-303 hereby waives the requirement of competitive bidding and <br /> directs the Purchasing Officer to purchase the above described equipment for the <br /> price set forth in Section 2 above. <br /> Section 4. EMERGENCY CLAUSE: It is further found that due to the <br /> immediate need to acquire the above described equipment, an emergency is <br /> declared to exist and this ordinance being necessary for the preservation of the <br /> public peace, health and safety shall take effect from and after its passage and <br /> approval. <br /> PASSED AND APPROVED this 9th day of January, 2007. <br /> Honorable R' c umbaugh, Mayor <br /> ATTEST: <br /> Denise M.
