ORDINANCE NO: — D AN ORDINANCE TO AMEND THE CURBSIDE WASTE DISPOSAL ORDINANCE WHEREAS, the current ordinances addressing curbside waste pickup does not reflect the City's current policies; WHEREAS, amendments to the current ordinances are necessitated by the purchases of new equipment and waste containers; and WHEREAS, the Council has determined that these issues should be resolved. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,ARKANSAS: SECTION 1: That Ordinance No. 90-10-1, Sec. 4 codified as 5.12.04 is hereby amended to read as follows: Requirements for Curbside Waste Pickup:. The City will initially provide curbside customers with one city owned waste container for curbside pickup. Additional containers may be rented from the city at a rate to be determined by resolution of the City Council. The City will only pick up curbside waste from City owned containers. Curbside customers shall be responsible for the costs associated with repairing or replacing damaged or lost garbage containers. All waste must be drained of liquid substance before it is placed in a garbage container. The waste container lids must be completely closed for curbside pickup. For all garbage and waste to be collected, it shall be in disposable containers or trash bags within the City containers when placed at curbside for collection. Said disposable containers should be secure enough that the garbage and waste contained therein remains contained therein during the collection process. Waste containers may not be placed in the front yard except at the times provided herein after. A front yard is that area of a lot as defined in the Batesville Zoning Code. All occupants shall place the waste containers adjacent to the street (at curbside) on the day of the week designated by the City for the collection of waste for that particular structure. Provided however, that for the convenience of the occupants, the garbage containers may be placed at curb side after 12:00 pm (Noon) on the day prior to collection for that structure. That said container(s) must be removed from the curb side by 12:00 pm (Noon) on the day after pickup. SECTION 2: That Ordinance No. 830, Sec. 4 codified as 5.12.07 is hereby amended to read as follows: Penalty for Violating Chapter 5.12. Any person violating Chapter 5.12 of the Batesville Arkansas Municipal Code, titled Solid Waste Collection, shall upon conviction thereof, be adjudged guilty of a violation and fined a sum of not less that Ten Dollars
