ORDINANCE NO�i -11-oa <br /> AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR <br /> OTHER PURPOSES. <br /> WHEREAS, King TEJ Leasing LLC has requested that certain property, described below, be re- <br /> zoned so as to align the zoning classification with the proposed use of said property and be consistent <br /> with the Comprehensive Plan; and <br /> WHEREAS, the Batesville Planning Commission has conducted a properly advertised public <br /> hearing on November 4, 2019; and, <br /> WHEREAS, the Batesville Planning Commission, at its regularly scheduled meeting on <br /> November 4,2019, has reviewed the relationship of this property with the Comprehensive Plan and <br /> determined that proposed use would be consistent with said Plan; and, <br /> WHEREAS,the Batesville Planning Commission has recommended that the requested <br /> amendment to the Zoning Districts map be approved by the City Council. <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> BATESVILLE, ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS <br /> HEREBY AMENDED AS FOLLOWS: <br /> From Community Commercial (C-1)to Traditional Business District(T-1) <br /> A part of Block 37 of Egner's Addition to the City of Batesville,Arkansas, described thus: <br /> Commencing at the Northeast corner of said Block 37 at the point of intersection of the South line <br /> of Boswell Street and the West line of Third Street,thence Southeasterly along the West line of <br /> Third Street 180 feet to the point of beginning; thence westerly and parallel with Boswell Street <br /> 75 feet; thence Northerly and parallel with Third Street 180 feet to a point on the South line of <br /> Boswell Street; thence Westerly along the South line of Boswell Street 65 feet to a point;thence <br /> Southerly and parallel with Third Street 180 feet; thence Westerly and parallel with Boswell <br /> Street 60 feet; thence Southerly and parallel with Broad Street 32 1/2 feet;thence Easterly and <br /> parallel with Boswell Street 156 feet to a point on the West line of River Street;thence Northerly <br /> along the West line of River Street and Third Street to the point of beginning. <br /> LESS AND EXCEPT: <br /> A part of Block 37 of Egner's Addition to the City of Batesville, Arkansas, described thus: <br /> Commence at the NE corner of said Block 37 at the point of intersection of the South line of <br /> Boswell Street with the West line of Third Street and run thence Southeasterly along West line of <br /> Third Street a distance of 180 feet to a point(being the SE corner of the Sheffield Tract);thence <br /> in a Westerly direction along the South line of the Sheffield'Tract 75 feet to a point;thence in a <br /> Northerly direction and parallel with Third Street along the West line of the Sheffield Tract a <br /> distance of 180 feet to a point on the South line of Boswell Street; thence Westerly and along the <br /> South line of Boswell Street a distance of 65 feet to a point(being the NE corner of what was <br /> formerly known as the Julia Rowlett tract);thence in a Southerly direction and along East line of <br /> the Rowlett tract a distance of 180 feet to the Point of Beginning;thence in a Westerly direction <br /> and along the South line of the Rowlett Tract a distance of 60 feet to a point; thence in a <br /> Southerly direction and parallel with Broad Street a distance of 32-1/2 feet to a point;thence in an <br /> Easterly direction and parallel with Boswell Street a distance of 60 feet;thence in a Northerly <br /> direction 32-1/2 feet to the Point of Beginning. <br /> IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR <br /> HELD TO BE INVALID, SUCH INVALIDITY SHALL NOT AFFECT THE <br /> REMAINING PORTION OR PORTIONS OF THIS ORDINANCE. <br /> IT IS SO ORDAINED. <br />
