® ORDINANCE NO. 2007-3-1 <br /> AN ORDINANCE REPEALING ORDINANCE NO. 801 OF 1971 AS AMENDED <br /> BY ORDINANCE NO. 97-10-1 OF 1997 OF THE CITY OF BATESVILLE, <br /> ARKANSAS AND DECLARING AN EMERGENCY <br /> WHEREAS, pursuant to the laws of the State of Arkansas, the City of <br /> Batesville, by Ordinance No. 801 of 1971, created the Batesville Water Utility (the <br /> "Commission") to operate the city owned water and sewer department; and <br /> WHEREAS, by Ordinance No. 97-10-1 of 1997, Ordinance No. 801 was <br /> amended in regards to the membership, terms and board of the Utility <br /> Commission; and <br /> WHEREAS, the City is now desirous of restoring to the Mayor and City <br /> Council of the City of Batesville the responsibility of operating the city owned <br /> water works, water distribution system and sewer system; and <br /> WHEREAS, Ordinance No. 801 of 1971 as amended by Ordinance No. <br /> 97-10-1 of 1997 is in conflict therewith. <br /> NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE <br /> CITY OF BATESVILLE, ARKANSAS <br /> Section 1. That Ordinance No. 801 of 1971 as amended by Ordinance <br /> No. 97-10-1 of 1997 which created the Commission be and hereby is repealed in <br /> its entirety effective upon passage of this ordinance. <br /> Section 2. That all other ordinances or parts of ordinances in conflict <br /> herewith are hereby repealed. <br /> Section 3. That the manager/supervisor of the Batesville Water <br /> Works/Batesville Water and Sewer Department shall report to, and be under the <br /> direct supervisory authority of the Mayor as a department head. <br /> Section 4. The current employees of the Batesville Water <br /> Works/Batesville Water and Sewer Department are grandfathered in as <br /> employees of the City of Batesville for purposes of complying with the nepotism <br /> rules of the City of Batesville. Any future employees of Batesville Water <br /> Works/Batesville Water and Sewer Department will have to comply with the <br /> nepotism rules applicable to all city employees. <br /> Section 5. The City Council recognizes the urgent need to provide <br /> continuous water and sewer services to the residents of the City of Batesville. <br /> Therefore, an emergency is declared to exist and this ordinance, being <br />
