ORDINANCE NOC o/ ?—0(0-01 <br /> AN ORDINANCE TO AMEND VARIOUS PROVISIONS OF THE BATESVILLE ZONING <br /> CODE; AND FOR OTHER PURPOSES. <br /> WHEREAS,the Batesville Planning Commission became aware of the possibility and desirability <br /> of locating a Children's Advocacy Center somewhere in the City; and, <br /> WHEREAS,the Batesville Planning Commission concluded that revisions to the code were <br /> necessary and appropriate to explicitly allow a facility to help children heal from abuse while holding <br /> offenders accountable; and, <br /> WHEREAS,the Batesville Planning Commission, after conducting a public hearing on June 18, <br /> 2018, has voted at its called meeting on June 18,2018,to recommend that certain items in Title 14 of the <br /> Batesville Municipal Code be revised to allow, either by right or conditionally, such a facility; and, <br /> WHEREAS,the Batesville City Council concurs in the recommendation of the Planning <br /> Commission and agrees that the location of a Children's Advocacy Center in Batesville would highly <br /> advantageous in promoting the health, safety and welfare of children. <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> BATESVILLE,ARKANSAS THAT CHAPTER 14.02 OF THE BATESVILLE ZONING CODE <br /> IS HEREBY AMENDED AS FOLLOWS: <br /> Section 1. Definition. <br /> The following new definition is added to Section 14.02.02 of the Batesville Zoning Code,between Child <br /> Care Facility and Church,to read as follows: <br /> "Children's Advocacy Center. A child focused, community-based facility that coordinates the <br /> investigation,prosecution and treatment of child abuse while reducing the trauma to child victims of <br /> physical abuse, sexual abuse, or neglect. Consistent with the requirements of Arkansas law,at ACA <br /> 20-78-105,as amended, such facilities emphasize the coordination of investigation and intervention <br /> services by collaboration among medical,mental health, prosecutorial,child protective and law <br /> enforcement professionals and agencies to create a child-focused approach to child abuse cases in a <br /> way that creates a sense of safety and security for the children. The facility may only operate as a <br /> non-residential use,but preferably in a residential or semi-residential environment. Only a tax- <br /> exempt 501(c)(3)non-profit organization that complies with the requirements of Arkansas law,as <br /> cited above,and is accredited,or actively seeking accreditation,through the National Children's <br /> Alliance,and is a member of the Children's Advocacy Centers of Arkansas will be considered to meet <br /> the requirements of this definition. <br /> Section 2. Child Advocacy Center permitted by right in the Historic Residential District(HR) <br /> Section 14.06.02.A. is amended by adding the following: "13. Child Advocacy Center" <br /> Section 3. Child Advocacy Center is permitted conditionally in other zoning districts as follows: <br /> In Single Family Residential(R-1)at 14.06.0l.B: Add "4. Children's Advocacy Center" <br /> In General Family Residential(R-2)at 14.06.03.B: Add "10. Children's Advocacy Center" <br /> In Traditional Business District(T-1)at 14.07.0l.B: Add "6. Children's Advocacy Center" <br /> In Commercial Community District(C-1)at 14.07.02.B: Add "5.Children's Advocacy Center" <br />
