ORDINANCE # /b `/U-d <br /> AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR THE REPAIR AND REMODEL OF <br /> THE BATESVILLE POLICE DEPARTMENT; AND FOR OTHER PURPOSES <br /> WHEREAS, the City recently purchased a building to house the Batesville Police Department; <br /> WHEREAS, that said building is in need of repair and renovation, including making said <br /> building compliant with the American's With Disabilities Act; <br /> WHEREAS, that the Police Department's need of the renovated facility is immediate; <br /> WHEREAS, that M & A Construction Co., Inc. is a local construction company who is available <br /> to begin work immediately and was the original builder of this property which gives it the intimate <br /> knowledge necessary for the remodel and repair to proceed quickly and efficiently; and <br /> WHEREAS, Arkansas Code Annotated § 14-58-303 allows this governing body by ordinance to <br /> waive the requirements of competitive bidding in exceptional situations; <br /> NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, <br /> ARKANSAS: <br /> Section 1: There are exceptional circumstances whereby the requirements of competitive are <br /> neither practical nor feasible and the City Council, therefore, waives the requirements of competitive <br /> bidding for the repair and remodel of the building located 51 Industrial Drive which is to be used as <br /> the headquarters of the Batesville Police Department. <br /> Section 2 - Severability Provision: If any part of this ordinance is held invalid, the <br /> remainder of this Ordinance shall continue in effect as if such invalid portion never existed. <br /> Section 3 — Repeal of Conflicting Provisions: All ordinances, resolutions or orders of the <br /> City Council, or parts of the same, in conflict with this Ordinance are repealed to the extent of such <br /> conflict. <br /> EMERGENCY CLAUSE: It is hereby found by the City Council that the Batesville Police <br /> Department's need of a new facility is immediate, therefore an emergency is declared to exist, and <br /> this ordinance being necessary for the preservation and advancement of public peace, health, <br /> finances and safety, shall be in full force and effect from and after the date of its approval. <br /> PASSED AND APPROVED this 9t" day of October, 2018. <br /> ou",j /)A HONORABLE CK ELUMBAUGH, MAYOR <br /> ENISE M.
