ORDINANCE # 2007-05-01 <br /> AN ORDINANCE TO AMEND THE BATESVILLE ZONING CODE. <br /> WHEREAS, The Batesville Zoning Code currently allows apartments in <br /> the T-1 Traditional Business District through the use of conditional use permits, <br /> and <br /> WHEREAS, said conditional use permits do not allow apartments to be <br /> permitted on the ground floor of any structure except for entry or exit, and <br /> WHEREAS, to further the re-vitalization of the T-1 Traditional Business <br /> District in the downtown area, and <br /> WHEREAS, it is determined that the city's best interests will be served by <br /> encouraging creative utilization of space in the T-1 Traditional Business District. <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF <br /> BATESVILLE, ARKANSAS THAT THE BATESVILLE ZONING CODE IS <br /> HEREBY AMENDED AS FOLLOWS: <br /> SECTION 1. Section VIII, COMMERCIAL DISTRICTS; <br /> I. T-1 Traditional Business District <br /> B. Conditional Uses <br /> currently reads: <br /> The following may be allowed by conditional Use Permit in accordance <br /> with the provisions of Section XIII: <br /> 1 . Apartments, when the Commission finds they do not use ground <br /> floor space, except for entry or exit, and do not interfere with the commercial <br /> nature of the neighborhood and do provide adequate parking. <br /> SECTION 2. This section is hereby amended to read as follows: <br /> The following may be allowed by conditional Use Permit in accordance <br /> with the provisions of Section XIII: <br />
