ORDINANCE NO. 20-217 I. 00 <br />AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; <br />AND FOR OTHER PURPOSES. <br />WHEREAS, Paula Terrell has requested that certain property, described as the <br />attached exhibits, located between 3096 Harrison Street and 3245 Juniper be rezoned so <br />as to change from R-1 Residential to R-2 Residential; and <br />WHEREAS, the Batesville Planning Commission has prepared recommendations <br />to assign permanent zoning district classifications to said properties, and conducted a <br />properly advertised public hearing on 8/2/21 and, <br />WHEREAS, the Batesville Planning Commission, at its regularly scheduled <br />meeting on 8/02121, has reviewed the relationship of this property with the <br />Comprehensive Plan and determined that the proposed use would be consistent with said <br />Plan: and, <br />WHEREAS, the Batesville Planning Commission has recommended that the <br />requested amendment to the Zoning District map be approved by the City Council. <br />NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF <br />THE CITY OF BATESVILLE, ARKANSDAS THAT THE BATESVILLE <br />ZONING DISTRICTS MAP IS HEREBY AMENDED AS FOLLOWS: <br />Section 1: That the following described Real Property in the City of Batesville, <br />Arkansas is hereby rezoned from R-1 Residential to R-2 Residential: <br />Legal description is attached hereto as Exhibit "A" and incorporated <br />herein by reference. <br />Section 2: That all ordinances and parts thereof in conflict herewith are hereby <br />repealed to the extent of such conflict. <br />Section 3: If any portion or portions of this ordinance are deemed or held to be <br />invalid, such invalidity shall not affect the remaining portions of this <br />ordinance. <br />IT IS SO ORDAINED. <br />IN wrlNESS WHEREOF, we have set our hands this 10th, day of August. 2021. <br />
