ORDINANCE NO. Y— 0& <br />AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; <br />AND FOR OTHER PURPOSES. <br />WHEREAS, Jeremy Hart has requested that certain property, described as the <br />attached two exhibits, located at 405 White Drive be rezoned so as to change from R- I <br />Residential to C-1 Commercial; and <br />WHEREAS, the Batesville Planning Commission has prepared recommendations <br />to assign permanent zoning district classifications to said properties, and conducted a <br />properly advertised public hearing on 8/2/21 and, <br />WHEREAS, the Batesville Planning Commission, at its regularly scheduled <br />meeting on 8/02/2 1, has reviewed the relationship of this property with the <br />Comprehensive Plan and determined that the proposed use would be consistent with said <br />Plan; and, <br />WHEREAS, the Batesville Planning Commission has recommended that the <br />requested amendment to the Zoning District map be approved by the City Council. <br />NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF <br />THE CITY OF BATESVILLE, ARKANSDAS THAT THE BATESVILLE <br />ZONING DISTRICTS MAP IS HEREBY AMENDED AS FOLLOWS: <br />From R-1 Residential to C-1 Commercial <br />IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD <br />TO HE INVALID, SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION OR <br />PORTIONS OF THIS ORDINANCE. <br />IT IS SO ORDAINED. <br />IN WITNESS WHEREOF, eve have set our hands this 1001, day of August, 2021. <br />Attest. <br />Denise Johnston, C14k <br />Approved as to legal form: <br />City Attomey <br />Approved/ <br />lunlayor <br />
