Millsap Rd., Fayetteville, AR 72703 <br /> KNOW ALL MEN BY THESE PRESENTS: <br /> THAT I/We, Landon Dilday, hereinafter called "Grantor" whether one or more, for and <br /> in consideration of the sum of ONE DOLLAR($1.00), and other valuable consideration, cash in <br /> hand paid by the CITY OF BATESVILLE, ARKANSAS, Independence County, the receipt of <br /> which is hereby acknowledged, do hereby grant, sell and convey to the CITY OF BATESVILLE <br /> hereinafter called "GRANTEE", its successors and assigns, the right of way and the right from <br /> time to time to lay, to construct,to reconstruct, replace, renew, maintain, operate, change the size <br /> of and remove pipelines and/or mains for the purpose of carrying potable water, the right to <br /> install valves, manholes, or other equipment necessary for the proper operation or protection of <br /> said mains, over,through or under and across the following: <br /> PROPERTY DESCRIPTION: <br /> The North Half of lot Three (3) in Block One (1) of Leonard's Addition to the City of Batesville, <br /> Arkansas. <br /> EASEMENT DESCRIPTION: <br /> A permanent easement 15.00 feet in width, being 7.50 feet on each side of the centerline of this <br /> permanent easement. The centerline of this permanent easement shall be the centerline of the <br /> waterline as constructed across the North side of Grantor's above described property, said <br /> centerline also described as follows: Commence at the intersection of Grantor's West property <br /> line and the new South right of way line for Highway 106 and run thence South 00° 23' 18" West <br /> along said West property line a distance of 10.62 feet to said centerline of said waterline as <br /> constructed for the "TRUE POINT OF BEGINNING" of this permanent easement description; <br /> thence leaving said West property line South 84° 5649" East along said centerline a distance of <br /> 37.89 feet; thence South 860 30' 52" East along said centerline a distance of 32.27 feet to <br /> Grantor's East property line for the end of this permanent easement, containing 1,052 square feet <br /> or 0.02 acres,more or less. <br /> TEMPORARY CONSTRUCTION EASEMENT DESCRIPTION: <br /> Also,atemporary construction easement adjacent to the North line of the above described <br /> permanent easement, being all the area between said North line of said permanent easement and <br /> the new South right of way line of Highway 106, containing 310 square feet or 0.007 acres, more <br /> or less. This temporary construction easement shall terminate when the waterline construction is <br /> complete and has been accepted by the City of Batesville,Arkansas. <br />
