ORDINANCE NO. <br />A ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR A GRAPPLE TRUCK <br />WHEREAS, the City of Batesville is in need of a new grapple truck; <br />WHEREAS, that there is currently a severe shortage of new grapple trucks <br />due to a lack of certain computer chips as well as other materials; <br />WHEREAS, that Hernard Utility Products, Inc. of Searcy has a slot available <br />for purchase order in 2022; <br />WHEREAS, if the City does not make said purchase order immediately, the <br />City will not be unable to reasonably acquire a new grapple truck until 2023 <br />through any vendor; and <br />WHEREAS, Arkansas Code Annotated § 14-58-303(b)(2)(B) allows this <br />governing body by resolution to waive the requirements of competitive bidding in <br />exceptional situations where bidding is deemed not feasible or practical; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF BATESVILLE, <br />ARKANSAS: <br />Section 1. That the purchase of a New Pac-Mac KB20H0-HJ "Grapple Truck" <br />from Henard Utility Products, Inc. for approximately $217,847.70 is hereby <br />authorized. <br />Section 2. That after diligent search it has been determined that this Grapple <br />Truck uniquely meets the city's specifications and can be delivered in a timely <br />fashion. Therefore, competitive bidding is deemed to not be feasible or practical, <br />and is hereby waived. <br />PASSED AND APPROVED this 9t" day of August, 2022. <br />Honorable Rick Elumbaugh, Mayor <br />ATTEST: <br />Denise M.
