ORDINANCE NO.2022-Q.?_D/ <br /> AN ORDINANCE TO AMEND VARIOUS PROVISIONS OF THE BATESVILLE ZONING <br /> CODE; TO ADD DEFINITIONS; TO CLARIFY PERMITTED USES; AND FOR OTHER <br /> PURPOSES. <br /> WHEREAS,the Batesville Planning Commission determined that the Batesville Zoning Code <br /> needs to clarify regulations pertaining to low impact cultural and recreational uses in residential zoning <br /> districts; and, <br /> WHEREAS,the Batesville Planning Commission has prepared recommendations to improve the <br /> clarity of the Batesville Zoning Code and conducted a public hearing on March 7,2022, and voted at a <br /> regular meeting on March 7, 2022 to recommend said revisions to the Batesville City Council; and, <br /> WHEREAS,the Batesville City Council concurs in the recommendations of the Planning <br /> Commission <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING CODE,THE SAME BEING <br /> TITLE 14 OF THE BATESVILLE MUNICIPAL CODE,IS HEREBY AMENDED AS <br /> FOLLOWS: <br /> Section 1. Amend the definitions in Section 14.02.02, subsection B., by Inserting the following between <br /> "Lodging Room"and "Manager/Caretaker Residence": <br /> "Low Impact Cultural and Recreational Facility. Any facility, such as a senior citizen <br /> center,designed to provide socialization, recreation, or related activities. Such facility <br /> should normally be limited to not more than 200 person at any one time and not provide <br /> any temporary or permanent residential occupancy, except during disaster related <br /> emergencies." <br /> Section 2. Amend Section 14.06.01 by adding the following: <br /> "5. Low impact cultural and recreational facilities" <br /> Section 3. Amend Section 14.06.03. by adding the following: <br /> "11. Low impact cultural and recreational facilities <br /> Section 4. Amend Section 14.07.02 by adding the following: <br /> "19. Low impact cultural and recreational facilities" <br /> Section 5. If any portion or portions of this ordinance are deemed or held to be invalid, such invalidity <br /> shall not affect the remaining portion or portions of this ordinance. <br /> Section 6. It is hereby determined that an opportunity to receive grant assistance to develop a needed <br /> development of a much needed modern facility for the benefit of the senior citizens of <br /> Batesville and an emergency is hereby declared and this ordinance shall be in full force and <br /> effect from and after the date of its passage and approval. <br /> IT IS SO ORDAINED. <br /> IN WITNESS WHEREOF, we have set our hands this 8th, day of March, 2022. <br /> APPROVED: <br /> RIC UMBAUGH R <br /> ATTEST: �JOHNSTON, <br /> ENISE C RK <br />
