o2N'--R -D y-oq <br /> AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR A CHRISTMAS CASTLE; <br /> AND FOR OTHER PURPOSES <br /> WHEREAS,the City of Batesville is renowned for its annual Christmas lights <br /> display which are displayed annually during the holiday season; <br /> WHEREAS,that City is committed to keeping and making said display one of <br /> the best in the state and the national region; <br /> WHEREAS,that Council of the City of Batesville wishes to add a large Christmas <br /> Castle to the display; <br /> WHEREAS, that said Castle is unique in its nature thus making competitive <br /> bidding unfeasible; and <br /> WHEREAS,Arkansas Code Annotated§14-58-303 allows this governing body by <br /> ordinance to waive the requirements of competitive bidding in exceptional situations; <br /> NOW,THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, <br /> ARKANSAS: <br /> Section 1: That it is neither practical nor feasible to open up the bidding <br /> process for the purchase of a Christmas Castle from Artistic Holiday Designs, and the <br /> City Council, therefore, waives the requirements of competitive bidding for said Castle, <br /> and approves the purchase thereof at the price of$75,400 more or less. <br /> Section 2 -Severability Provision: If any part of this ordinance is held invalid, <br /> the remainder of this Ordinance shall continue in effect as if such invalid portion never <br /> existed; <br /> Section 3 - Repeal of Conflicting Provisions: All ordinances, resolutions or <br /> orders of the City Council, or parts of the same, in conflict with this Ordinance are <br /> repealed to the extent of such conflict. <br /> EMERGENCY CLAUSE: That time is of the essence for the proposed purchase, <br /> therefore an emergency is declared to exist, and this ordinance being necessary for the <br /> preservation and advancement of public peace,health, finances and safety, shall be in <br /> full force and effect from and after the date of its approval. <br /> PASSED AND APPROVED this J01 6-of April, 2022. <br /> Honorable Rick Elumbaugh, Mayor <br /> Denise M.
