THIS INSTRUMENT PREPARED BY: <br /> T.Lindsey Castleber ] <br /> Attorney at Law V <br /> 500 East Main Street,Suite 301 <br /> Post Office Box 2604 <br /> Batesville,Arkansas 72503 <br /> (870)307.0050 <br /> LEASE ADDENDUM <br /> WHEREAS,the City of Batesville("LESSOR")leased the lands described in <br /> EXHIBIT"A"on January I, 1999, by Lease Agreement("Lease Agreement")recorded in <br /> Deed Book 2004, Page 2505: <br /> WHEREAS,the leasehold interest in the Lease Agreement was subsequently <br /> assigned and ultimately transferred to Steve Carpenter,who currently possesses the <br /> premises in accordance with the terms and conditions set forth in the aforesaid Lease <br /> Agreement, <br /> WHEREAS, Steve Carpenter's restaurant located on the demised premises <br /> was recently destroyed by fire and he desires to rebuild on the demised premises; <br /> WHEREAS, LESSOR and Steve Carpenter(hereinafter referred to as LESSEE) <br /> wish to modify and extend the Lease Agreement in order to allow construction of a new <br /> restaurant on the demised premises,and they commit the terms of the modification to <br /> writing and for that purpose join in the execution of this instrument; <br /> NOW,THEREFORE, in consideration of the premises,and in consideration of <br /> the following conditions and agreements, the LESSOR and LESSEE agree that the <br /> Lease Agreement remain in full force and effect and shall be modified as follows: <br /> 1. The lands hereby leased by LESSOR to LESSEE,and hereinafter referred to <br /> as the demised premises,are situated in Batesville, Independence County, Arkansas, <br /> and more particularly described as Lease No. I set forth in EXHIBIT"A",attached <br /> hereto. <br /> Book 2019 Page 47 <br />
