ORDINANCE NO. <br />AN ORDINANCE AMENDING THE TEMPORARY ENTERTAINMENT DISTRICT <br />BOUNDARIES IN RIVERSIDE PARK IN BATESVILLE, ARKANSAS <br />WHEREAS, that through the diligent efforts of Main Street Batesville, as well as the support of <br />the City of Batesville and the residents of Independence County, Batesville was one of thirty-three towns <br />and cities Nationally awarded a Levitt Foundation Grant to be used to fund a summer concert series, and <br />WHEREAS, said concert series will be held at the Amphetheatre at Riverside Park; and <br />WHEREAS, last year the City established a Temporary Entertainment District ecompassing <br />the area at Riverside Park from south from Steelhouse Branch between the White River and Chaney <br />Drive to the River restaurant. <br />WHEREAS, that in order to better promote the atmosphere surrounding these concerts, the <br />Tempoaray Entertainment District should be expanded to encompass the areas around the <br />Ampetheater, and <br />WHEREAS, the Council believes that the expansion of a temporary entertainment district will <br />help promote business and tourism., and <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />BATESVILLE, ARKANSAS, AS FOLLOWS: <br />Section 1. That "Exhibit A"of Section 1 Ordinance Number 2022-06-02, which <br />established the Temporary Entertainment District at Riverside Park is hereby amended as outlined <br />in "Exhibit A" which is attached hereto and incorporated herein by reference. <br />Section 2. That all ordinances and parts thereof in conflict herewith are hereby repealed to <br />the extent of such conflict. <br />Section 3. If any portion or portions of this ordinance are deemed or held to be invalid, such <br />invalidity shall not affect the remaining portions of this ordinance. <br />Section 4. It is, therefore, declared that an emergency exists and this Ordinance being <br />necessary for the immediate preservation of public peace, health, safety and welfare shall be in force <br />and take effect immediately upon its passage. <br />PASSED AND APPROVED THIS DAY OF APRIL, 2023. <br />Rick Elumbaugh, Mayor <br />ATTEST: <br />Denise Johnston, City Clerk <br />
