RESUOLUTION NO. 2023 -7-0 = <br /> CITY OF BATESVILLE, ARKANSAS <br /> A RESOLUTION APPROVING OF THE HIRING OF AN INDEPENDENCE COUNTY <br /> DEPUTY DISTRICT COURT CLERK <br /> WHEREAS, Debbie Coker recently retired from her position as a deputy clerk from the <br /> Independence County District Court after 19 years of dedicated an honorable service; <br /> WHEREAS,that Independence County District Court Judge Chaney Taylor has requested that <br /> Independence County hire a replacement for said position; <br /> WHEREAS, it is Independence County's position that under Arkansas Code Annotated 16- <br /> 17-106,the governing body of the city of Batesville must approve the appointment of a deputy clerk; <br /> WHEREAS,the City of Batesville disagrees with the County's position, and asserts its <br /> position that the City of Batesville has no governing or operational control over the Independence <br /> County District Court; and <br /> WHEREAS, historically and currently, Independence County solely operates the <br /> Independence County District Court, which includes all staffing decisions. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Batesville, <br /> Arkansas: <br /> Section 1: In order to resolve this dispute and in the interest of the promotion of justice <br /> within our collective communities the city of Batesville, Arkansas approves of the hiring of a deputy <br /> clerk at the Independence County District Court to replace Debbie Coker's position. <br /> Section 2: That this resolution is nonbinding in nature as the City of Batesville currently <br /> has no authority, nor has it historically, in the operation and staffing of Independence County District <br /> Court. <br /> ADOPTED THIS / DAY OF 4 , 2023. <br /> APPROVED: <br /> RICK ELUMBA , <br /> ATTEST: <br /> DENISE JOHNST , CITY CLERK <br />
