ORDINANCE NO 3_0 7 -0 <br /> AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR <br /> OTHER PURPOSES. <br /> WHEREAS,the Batesville Zoning District map was amended in 2021, Ordinance No. 2021- <br /> 05-1, to allow for the construction of an eight unit multi-family housing project on a single lot; and <br /> WHEREAS, the Batesville Fire Department has requested a change to the access driveway <br /> to the property, which requires the Zoning District map to be amended, and said amendment be <br /> approved by the City Council. <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF BATESVILLE,ARKANSAS: <br /> SECTION 1. The property to be zoned as a Planned Development is described under the <br /> sections labeled "Legal Description" and "Proposed Legal Description" in "Attachment A" attached <br /> hereto and incorporated herein by reference. <br /> SECTION 2. Said property shall be developed in accordance with the Site Plan attached <br /> hereto as "Attachment A." No deviation is permitted. Failure to develop said property in strict <br /> accordance with said Site Plan, or failure to begin work within one (1) year, shall nullify the Planned <br /> Development District classification and zoning shall revert back to its original zoning. <br /> SECTION 3: That any ordinances in conflict herewith are repealed to the extent of that <br /> conflict. Specifically, Ordinance No. 2021-05-01 is hereby repealed. <br /> SECTION 3.
