CERTIFICATE OF CITY CLERK CERTIFYING <br />PROCLAMATION AND BALLOT <br />STATE OF ARKANSAS <br />COUNTY OF INDEPENDENCE <br />I, the undersigned, City Clerk of the City of Batesville, Arkansas (the "City"), <br />hereby certify that the Certificate of the Independence County Board of Election Commissioners <br />certifying the vote at the election held in the City on August 8, 2023 on the questions of (a) <br />approving or rejecting Ordinance No. 2023-05-02, which if approved, would amend Ordinance <br />No. 2011-12-05 in order to authorize the net collections of the 0.5% sales and use tax levied <br />within the City by Ordinance No. 2011-12-05 (the "Tax") to be used to pay and secure the <br />repayment of bonds approved by the voters and issued by the City from time to time to finance <br />and refinance all or a portion of the costs of capital improvements, has been filed in my office <br />and presented to the Mayor and reflects that 2" votes were cast FOR the measure and <br />votes were cast AGAINST it; (b) issuing bonds in the maximum aggregate principal amount o <br />$12,820,000 for the purpose of refunding the City's Sales and Use Tax Bonds, Series 2012 and, <br />in order to pay the bonds, the pledge of the Tax, has been filed in my office and presented to the <br />Mayor and reflects that isR votes were cast FOR the measure and votes were cast <br />AGAINST it; (c) issuing bonds in the maximum aggregate principal amount of $25,985,000 for <br />the purpose of financing all or a portion of the costs of park and recreational facilities and <br />improvements and any necessary land acquisition, demolition, furnishings, equipment and <br />parking, lighting, landscaping, street, drainage and utility improvements related thereto and, in <br />order to pay the bonds, the pledge of the Tax, has been filed in my office and presented to the <br />Mayor and reflects that Sqo votes were cast FOR the measure and.L-LQ votes were cast <br />AGAINST it; and (d) issuing bonds in the maximum aggregate principal amount of <br />$110,000,000 for the purpose of financing all or a portion of the costs of acquiring, constructing <br />and equipping extensions, betterments and improvements to the City's water system and any <br />necessary demolition related thereto and, in order to pay the bonds, the levy and pledge of a 1 % <br />local sales and use tax within the City, has been filed in my office and presented to the Mayor <br />and reflects that 9& votes were cast FOR the measure and A3% votes were cast AGAINST it. <br />I certify that the copy of the printed ballot attached to the Certificate of the <br />Independence County Board of Election Commissioners is a true and correct copy of the ballot <br />used at the Special Election, a copy of which has been filed in my office. <br />I further certify that the attached Proclamation is a true and compared copy of a <br />Proclamation of the Mayor of the City, canvassing the returns of the election and declaring the <br />results thereof, which is now of record in the office of the City Clerk. <br />
