ORDINANCE NO. <br />AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS CODE; AND FOR <br />OTHER PURPOSES. <br />WHEREAS, the Batesville Planning Commission has been in continuing deliberations regarding <br />the advisability of permitting certain non-residential uses within residential zoning districts, and more <br />specifically within the R-1 Single Family Residential District; and, <br />WHEREAS, the Batesville Planning Commission determined that a moderate expansion of <br />permitted public or quasi -public uses on a conditional basis, if done in accordance with the <br />Comprehensive Plan, would be appropriate and in the best interests of the city; and, <br />WHEREAS, the Batesville Planning Commission conducted a properly advertised public hearing <br />on October 2, 2023 to hear public comment about the proposed Zoning Code revision; and, <br />WHEREAS, the Batesville Planning Commission, at its regular meeting on October 2, 2023, has <br />determined that the proposed zoning revision is consistent with the Batesville Comprehensive Plan, as <br />amended, and is in the best interest of the future development of the city; and, <br />WHEREAS, the Batesville Planning Commission has recommended that the requested <br />amendment to the Zoning Code be approved by the City Council. <br />NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />BATESVILLE, ARKANSAS: <br />Section 1. Subsection B. "Conditional Uses" of Section 14.06.01. "Single -Family Residential District <br />[R-1 ]" of the Batesville Zoning Code is hereby amended to add the following: <br />6. Public facilities such as quiet government offices not involving any form of incarceration; <br />7. Quasi -public facilities such as non-residential educational and/or vocational training facilities <br />during daytime hours, or similar uses <br />SECTION 2. If any portion or portions of this ordinance are deemed or held to be invalid, such <br />invalidity shall not affect the remaining portion or portions of this ordinance. <br />SECTION 3. The Council is aware that a transfer of property ownership between the Batesville School <br />District and the Independence County Sheriffs Office is imminent and needs to be concluded before the <br />end of the year and that such transfer is in the best interest of the future development of the city; <br />therefore, an emergency is hereby declared to exist and this ordinance shall be in effect from and after its <br />passage. <br />IT IS SO ORDAINED. <br />IN WITNESS WHEREOF, we have set our hands this , day of , 2023. <br />APPROVED: <br />RICK ELUMBAUGH, MAYOR <br />ATTEST: <br />
