ORDINANCE NO. <br /> AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS CODE; AND FOR OTHER <br /> PURPOSES. <br /> WHEREAS,the Batesville Planning Commission has been in continuing deliberations regarding the <br /> advisability of permitting certain non-residential uses within residential zoning districts,and more specifically <br /> within the R-1 Single Family Residential District; and, <br /> WHEREAS,the Batesville Planning Commission determined that a moderate expansion of permitted <br /> public or quasi-public uses on a conditional basis, if done in accordance with the Comprehensive Plan,would be <br /> appropriate and in the best interests of the city; and, <br /> WHEREAS,the Batesville Planning Commission conducted a properly advertised public hearing on <br /> October 2,2023 to hear public comment about the proposed Zoning Code revision; and, <br /> WHEREAS,the Batesville Planning Commission, at its regular meeting on October 2,2023,has <br /> determined that the proposed zoning revision is consistent with the Batesville Comprehensive Plan,as amended, <br /> and is in the best interest of the future development of the city; and, <br /> WHEREAS,the Batesville Planning Commission has recommended that the requested amendment to the <br /> Zoning Code be approved by the City Council. <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> BATESVILLE,ARKANSAS: <br /> Section 1. Subsection B. "Conditional Uses"of Section 14.06.01. "Single-Family Residential District[R-1]"of <br /> the Batesville Zoning Code is hereby amended to add the following: <br /> 6. Public facilities such as quiet government offices not involving any form of incarceration; <br /> 7. Quasi-public facilities such as non-residential educational and/or vocational training facilities during <br /> daytime hours, or similar uses <br /> SECTION 2. If any portion or portions of this ordinance are deemed or held to be invalid, such invalidity shall <br /> not affect the remaining portion or portions of this ordinance. <br /> SECTION 3.
